Practice areas

Disputes Kent mediates

A litigator's background in these areas means the facts, the exposure, and the pressure points are familiar before the first brief arrives.

Personal injury

Auto, premises, and general negligence claims, from pre-litigation demands to cases on the eve of trial. Damages evaluated candidly on both sides of the table.

Employment

Wrongful termination, discrimination, harassment, retaliation, and wage and hour claims. Years of employment law practice on the defense and plaintiff side of these issues.

Business disputes

Contract, partnership, and commercial litigation where the parties often need to keep working together after the case ends.

Insurance

Coverage disputes, bad faith claims, and subrogation matters, with an understanding of how carriers evaluate and authorize settlement.

Approach

A determined mediator

"Mediation gives the parties control of the outcome instead of leaving everything in the hands of a judge or jury."

Kent believes settlement is almost always preferable to the cost, delay, and risk of litigation, and he works the case until the parties get there.

  • Prepared. He reads everything before the session: the procedural history, the facts, the discovery, the motions, the damages, and every prior offer.
  • Trusted. Open communication only happens when each side trusts the person in the middle. Building that trust with the attorneys and their clients is the first job of the day.
  • Impartial. Ethics, integrity, and even-handedness, so that every party leaves feeling the process was fair whatever the result.
  • Persistent. If the case doesn't resolve in the room, Kent stays involved afterward until it does.

What to expect

Schedule

Email or call with the case name, the parties, and several possible dates. Zoom or in person at one of counsel's offices.

Submit briefs

Each side sends a written brief at least five days ahead: background, facts, discovery and motions, damages, and prior settlement discussions.

Mediate

A confidentiality agreement first, then private sessions with each side and joint sessions as the case calls for. The format fits the dispute, not a template.

Follow through

Most matters resolve the same day. The ones that don't get continued attention until they do.
